An important amendment to Article 6 of the New York Labor Law is to become effective on October 26, 2009. The amendment affects New York Labor Law section 195, and requires New York employers to advise all new employees in writing of their regular rate of pay and pay day.
Employers are also require to provide employees who are entitled to overtime under New York State and federal law their regular hourly rate and overtime rate. The amendment to New York Labor Law 195 requires that the employer obtain a written acknowledgment from the employee confirming that the employee has received the notification under the amendment.
The amendment does not apply retroactively. Rather, the notice must only be provided to employees hired on or after October 26, 2009.
